Music Piracy, Youtube, and the Fans. A Tyger rant.
A fairly quick EDUCATIONAL rant about the music industry, and their absolute paranoia over “copyright infringement”. If I had the money I’d fight them and argue “fair use” laws, but they have more money and more lawyers. And as we all know you don’t need to be right, you just need to have the right lawyers.
And a LINK! http://www.hollywoodtoday.net/2008/12/21/warner-music-group-pulls-the-plug-on-youtube/ Warner Music is throwing a hissy fit because youtube isn’t paying them enough money! A multi-BILLION dollar company is pulling a juvenile stunt. Thanks Warner Music! And thanks youtube for bending over and taking it rather than stepping up to defend your users! Way to go!!!!
I believe it was Carlos Santana who said something like this first. “They claimed that home taping would kill the music industry. Then they said home CD’s would kill the music industry. Then napster would kill the music industry. Bad music is what’s killing the music industry.”
§ 107. Limitations on exclusive rights: Fair use40
Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include —
(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
(2) the nature of the copyrighted work;
(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
(4) the effect of the use upon the potential market for or value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

I support you! …
I support you! Music producers should adopt. Its funny that even though artists make most of their money from concerts, they still choose to make pennies of their albums… ridiculous and shortsighted….
Great shirt!!! Where do I get it??

Brilliant Rob
…
Absolutely brilliant. Some of the most played Major Label songs on YouTube are featured on fan channels. I wonder why they don’t rush to delete a video with their artist that has several million views… Perhaps because then they wont be at the top anymore.

This guy is so …
This guy is so right.
99% of the bands that I developed a liking for….I discovered them via AMV’s, or game footage videos, or etc etc. Or they were recommended to me by a friend.
People are downloading music @ FULL QUALITY gigabytes and gigabytes at a time. What the is the point of banning it off youtube? Any idiot with an internet connection can download the song that you just removed in less than 10 seconds anyway, and at full album quality.
WMG or w/e are stupid.

I make AMV’s and a …
I make AMV’s and a bunch of videos of mine have been muted/taken down.
I always put credits in my videos and I know that I’ve definately helped make some bands known.
It’s not like I’m making any money off of it and I’ve bought the CDs, so I don’t see how it’s stealing. It’s just for fun. I would think that’s what artists want: for people to enjoy their work.
It really ticks me off with how greedy the music industry has gotten.
Anyway, you’re my hero.

No Asshole. I am a …
No Asshole. I am a composer. You do not have the right to use my music for any reason unless you have my permission. It has nothing to do with money. Frankly, if you are caught using materially without permission again, I will petition YouTube to have prosecuted. My music is not to be used as background for your crappy videos, period!

Most people don’t …
Most people don’t understand copyright laws. You do not have the right to publish or distribute the works or ideas of others without their permission, regardless of your intentions. It is clear you do not understand this concept and think that copyright means only using something commercially.
Fair Use is something completely different. You have the right to refer to a work or use a sample, as in a quote. You must nevertheless credit Fair Use usage. That’s the law.

Friend, I’ve got a …
Friend, I’ve got a great idea for a new product. It will make millions. Let’s see I will need capitol to design, produce and market it. And it because it is a brand new product, I will need a patent. But go ahead, use it if you like. No problem. The millions spent developing an artists career is nothing to jack like you. Go ahead and post their music to your stupid videos and not pay them a single cent for it.
We call what you are doing stealing.
May 7th, 2010 at 4:01 pm
Actually, I *have*, …
Actually, I *have*, I’m internationally published, and I’ve been plagiarized in my lifetime. Did I think they were stealing my money? No, I was paid for my work already.
Copyright law is broken, the artists who make the works aren’t being compensated by the law, the publishers and executives are.
May 7th, 2010 at 4:01 pm
Just make sure you …
Just make sure you allow everyone who wants to, to steal YOUR money, too. Are you ready for that? No? Oh, OK, then i guess you can’t steal other people’s money then. Cause then, you’d just be another ignorant hypocrite, wouldn’t you?
Copyrights are “bullshit?” Have you ever produced anything in your life? Have you ever made a LIVING off the ownership of what you produce? No? Then you have NO IDEA what you’re talking about, do you? Time to go back to the corner and shut up now.
